Terms of service

1. About these terms

These terms govern your use of Quarterwise, provided by MALDEN LTD, trading as Quarterwise ("we", "us"), a company registered in England and Wales (company number 11672272) with its registered office at 20–22 Wenlock Road, London, England, N1 7GU. By creating an account you agree to them. They work alongside our privacy policy, which explains how we handle your data.

2. The service

Quarterwise helps you keep digital records of rental income and expenses and prepare and submit Making Tax Digital for Income Tax updates and the final declaration to HMRC. We provide software; we are not your accountant and the service is not a substitute for professional tax advice. You are responsible for the accuracy of the figures you submit.

3. Your account

You must provide accurate information and keep your login secure. You are responsible for activity under your account. You must be at least 18 and use the service for your own tax affairs (or, where permitted, those of someone who has authorised you).

4. Acceptable use

You agree not to:

  • use the service unlawfully, or to submit information you know to be false;
  • attempt to access other users' data or disrupt, overload or probe the service;
  • copy, resell, reverse-engineer or attempt to extract the source of the software, except where the law allows;
  • upload anything containing malware or another person's data without a lawful basis.

5. Plans and payment

The Free plan covers a single property. Paid plans are billed monthly or yearly as shown at checkout and can be cancelled at any time; cancelling stops future renewals and you keep access until the end of the period you have paid for. Paid plans carry a 30-day money-back guarantee. None of this affects your statutory rights as a consumer.

6. HMRC submissions

We transmit the figures you approve to HMRC on your behalf. You remain responsible for filing accurately and on time. We are not liable for penalties arising from incorrect information you provide or from your failure to approve a submission before its deadline.

7. Intellectual property and your data

The Quarterwise software, brand and content are owned by us and licensed to you for use of the service while your account is active. The records and information you enter remain yours; you can export them or delete your account at any time, as described in our privacy policy. You grant us the limited permission needed to host and process your data in order to provide the service.

8. Availability and warranties

We work to keep the service available and accurate, but we provide it "as is" and cannot guarantee it will be uninterrupted or error-free. We may carry out maintenance and may rely on third parties (including HMRC) whose availability we do not control. This clause does not affect your statutory rights.

9. Liability

To the extent permitted by law, our liability is limited to the fees you have paid us in the preceding twelve months. We are not liable for indirect or consequential loss. We do not exclude or limit liability where it would be unlawful to do so, including for death or personal injury caused by negligence, or for fraud.

10. Suspension and termination

You can close your account at any time. We may suspend or end your access if you breach these terms, if required by law, or to protect the service or other users; where reasonable we will give notice. On termination you may export your data first, after which we delete it in line with our privacy policy, except where we must keep certain records by law.

11. Changes

We may update these terms; we'll tell you about material changes by email.

12. Governing law

These terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction, subject to any consumer-protection rights you have to bring proceedings elsewhere.
